Circlo — Terms of Service and Conditions

1. Introduction and Scope
These Terms of Service and Conditions ("Terms") govern all consumer-facing products, services, and platforms operated by Naviza B.V., including Circlo Editions (new products) and Circlo Loop (resale and consignment services). By accessing or using any Circlo platform, you accept these Terms in full. These Terms apply to private consumers within the EU and are governed exclusively by Dutch law.
All business customers, including those participating in corporate programs (Engage, Issued By, Capture to Create), are subject to separate commercial contracts that supersede these Terms.
2. Definitions
- Circlo Editions – New garments and accessories designed, produced, and sold directly by Circlo.
- Circlo Loop – Circlo’s resale and consignment platform for pre-owned clothing.
- Seller / Consignor – A customer who submits garments to Circlo Loop for resale.
- Buyer – A customer purchasing items from Circlo Editions or Circlo Loop.
- Processing – Intake, inspection, photography, pricing, listing, and storage for Circlo Loop items.
3. Orders and Availability
All orders are subject to acceptance and product availability. Prices are listed in euros (€) including VAT. Payment options include iDeal, major credit cards, PayPal, Shopify Pay, and Klarna.
If an ordered product becomes unavailable after purchase, Circlo will notify the customer and offer an alternative or a refund. Delivery must occur within 30 days unless another timeline is agreed.
4. Prices and Payment
All prices include VAT. Orders are shipped only after payment is received. Applicable shipping charges are displayed at checkout.
5. Shipping and Delivery
Circlo ships within the EU.
Estimated delivery times: 2–7 business days (non-binding). Delivery times may fluctuate due to peak volume, carrier delays, or other factors beyond Circlo’s control.
Netherlands shipping fees:
- Under €50: €4.95
- €50–€99.99: €2.95
- Over €100: Free
If a customer provides an incorrect delivery address, the customer is responsible for additional reshipping costs.
6. Returns and Refunds — Circlo Editions
a. Legal Right of Withdrawal
Consumers have a statutory 14‑day withdrawal period beginning on the day the order is received. Items must be returned in a condition allowing resale. Normal handling for examination purposes is permitted.
b. Voluntary 30‑Day Return Policy
Circlo offers a 30‑day voluntary return window for unused, unworn items. The original Circlo hang tag must be attached. Personalized or custom-made items and intimate garments are non-returnable.
c. Return Costs
- Orders above €100: Free returns
- Orders below €100: €2.95 return fee
- Original shipping costs are non-refundable unless Circlo sent an incorrect or defective item.
d. Refund Processing
Refunds are issued within 14 days after Circlo receives and inspects the returned item.
7. Warranty — Circlo Editions
Circlo Editions products include the EU‑mandated 2‑year legal warranty for manufacturing defects.
Manufacturing defects include flaws in workmanship or materials that prevent normal use. Exclusions include normal wear, improper care, pilling, minor shrinkage, fabric ageing, or accidental damage.
Customers must notify Circlo of warranty issues within a reasonable period after discovering a defect.
8. Circlo Loop — Buyer Terms
All Circlo Loop items are pre-owned. While we perform quality checks, minor wear is expected and does not constitute a defect.
In accordance with EU law, Buyers have a 14-day right of withdrawal. However, due to the unique nature of pre-owned items, returns will only be accepted if the Circlo Hang Tag remains attached and the item is in the exact condition it was received.
The customer is responsible for the return shipping costs.
9. Circlo Loop — Seller & Consignment Terms
a. Ownership
Sellers retain ownership of consigned items until the moment an item is sold to a buyer.
b. Processing & Listing Timeline
Circlo aims to process, photograph, and list items within 14–28 business days. This timeframe is indicative only and may vary.
c. Acceptance Criteria
Items are subject to a final quality inspection upon arrival. Any items found not suitable for resale due to condition or hygiene reasons will be redistributed through Circlo channels, or as an exception, recycled. Any items not suitable for resale due to authenticity, weapons, or offensive content, will automatically be recycled.
By sending items to Circlo Loop, the Seller acknowledges that items will not be returned unless a retrieval request is made within 14 days of receipt by Circlo (subject to fees in Section 9.f).
d. Pricing & Commission
Circlo determines final pricing using internal pricing rules and market benchmarks.
- Seller commission: 40% of final sale price
- Circlo may adjust pricing at any time to improve sell‑through.
e. Payout Schedule
Payouts occur at the end of the calendar month following the month your item was delivered. This buffer allows for shipping times and our standard return window.
f. Retrieval of Items
Sellers may request item retrieval before a sale has occurred.
- Shipping fee: €7.95 (NL) / €12.95 (EU)
- Handling fee: €3.95 per item
Once photographed or listed, items remain eligible for retrieval under the same fees.
g. Unsold Items
For items that remain unsold after 180 days, Circlo will initiate a final review.
1. Items with an initial price of €100 or more: Circlo will contact the Seller via their registered email. The Seller has 14 days to choose one of the following:
- Extend: Continue the listing at a newly proposed (discounted) price.
- Retrieve: Have the item returned (subject to fees in Section 9.f).
- Buy-Back: Circlo will purchase the item from the Seller at its current listed price (minus the 60% Circlo commission/service fee). Upon payment, ownership transfers to Circlo.
Note: If the Seller does not respond within 14 days, Circlo reserves the right to execute the Buy-Back option automatically to clear inventory.
2. Items with an initial price of €99 or less: When an item reaches 180 days or hits the minimum price floor of €5 through price decay, whichever comes first:
- Circlo will automatically purchase the item for the final floor price (minus fees).
- Following this payout, Circlo may redistribute, reuse, or recycle the item in accordance with our circularity mission.
h. Limitation of Liability
Circlo is not liable for minor wear, deterioration, or loss during storage or handling, except in cases of demonstrated gross negligence.
i. Distributed Selling & Multi-Channel Listing
To maximize the likelihood of a sale, Circlo reserves the right to list consigned items on third-party marketplaces, social commerce platforms, or through authorized partner boutiques.
- Pricing: Items sold via Distributed Selling channels will remain subject to the pricing rules in Section 9(d), though minor price variations may occur due to external platform fees or currency conversion.
- Seller Commission: The Seller’s 40% commission will always be calculated based on the net sale price (the final price paid by the buyer, excluding shipping and platform-specific transaction taxes).
- Terms of Sale: Any items sold on third-party platforms, are subject to the standard for returns of those platforms.
10. Transfer of Ownership
- Circlo Editions: Ownership transfers upon successful delivery and payment.
- Circlo Loop: Ownership transfers from the seller to the buyer at the moment of sale.
11. Product Descriptions and Liability
Circlo makes reasonable efforts to ensure accuracy in product descriptions. Slight variations in color, material, or fit may occur.
Circlo’s liability is limited to the value of the order. Circlo is not responsible for indirect or consequential damages.
12. Intellectual Property
All logos, designs, product images, and content are the property of Naviza B.V. Customers and sellers grant Circlo a non-exclusive right to use product images and user-generated content for marketing.
13. Privacy, Data Protection & Cookies
Circlo processes personal data in compliance with the GDPR. Full details are available in our Privacy Policy.
14. User-Generated Content
Submission of reviews, photos, or comments grants Circlo permission to use this content for marketing and communication.
15. Promotions
Promotions may carry additional conditions and cannot be combined unless explicitly stated.
16. Circularity & Sustainability
Circlo may reuse packaging to reduce environmental impact and encourages customers to return packaging for reuse. Circlo may recycle or repurpose products in line with circularity principles.
17. Dispute Resolution
For complaints, customers should first contact service@circlowear.com. If the issue remains unresolved, disputes may be escalated to mediation in the Netherlands. EU consumers may submit complaints via the EU Online Dispute Resolution platform.
18. Force Majeure
Circlo is not liable for delays or non-performance caused by events beyond its reasonable control.
19. Acceptance of Terms
Using any Circlo service constitutes acceptance of these Terms.

21. Changes to Terms
Circlo may update these Terms at any time. Continued use of Circlo services indicates acceptance of any revised Terms.
